Just sent the following letter:
To whom it may concern,
in response to your letter on February 25, 2019 to my letter on the same day.
Iâm very disappointed at your response. It is very well possible to accept my âforeignâ IBAN. In fact, I believe that under European law you would be required to accept my âforeignâ IBAN.
But seeing that one of the credits will be paid off in October 2019 and the other one in January 2020 should I choose to stay with the payment plans, and the possibility of me paying them off earlier than planned with Sonderzahlungen, I will refrain from my right to pursue the matter any further. I will recall my direct debit and manually make the payments on the first day of each month until my credits are paid in full.
Iâm also informing you that on February 28, 2019, just before I received you rejection letter, I received a phone call from a Targobank representative offering me a credit with better conditions to pay off current credit card debt with other Banks. I turned down the offer to a meeting but told the representative that I was interested and would consider meeting with him sometime in the near future. I can assure you Madam or Sir, that unless TargoBank changes its policies concerning "foreign" IBAN's, I will not consider doing any further business with this bank.
So please Madam or Sir, carefully read the following and eventually address this matter:
Darf ein ZahlungsempfĂ€nger einer Lastschrift vorgeben, in welchem Land das Konto des Zahlers gefĂŒhrt wird?
Nach Art. 9 Abs. 2 der Verordnung (EU) Nr. 260/2012 des EuropĂ€ischen Parlaments und des Rates vom 14. MĂ€rz 2012 zur Festlegung der technischen Vorschriften und der GeschĂ€ftsanforderungen fĂŒr Ăberweisungen und Lastschriften in Euro und zur Ănderung der Verordnung (EG) Nr. 924/2009 (SEPA-Verordnung) gibt ein ZahlungsempfĂ€nger, der eine Ăberweisung annimmt oder eine Lastschrift verwendet, um GeldbetrĂ€ge von einem Zahler einzuziehen, der Inhaber eines Zahlungskontos innerhalb der Union ist, nicht vor, in welchem Mitgliedstaat dieses Zahlungskonto zu fĂŒhren ist, sofern das Zahlungskonto gemÀà Artikel 3 erreichbar ist.
Unternehmen, die ihren Kunden anbieten, per Lastschrift zu bezahlen, dĂŒrfen den Lastschrifteinzug nicht auf Girokonten beschrĂ€nken, die bei einem Kreditinstitut im Inland gefĂŒhrt werden. Anderenfalls liegt ein VerstoĂ gegen Art. 9 Abs. 2 SEPA-Verordnung vor.
