‼️ Important update for businesses in Spain: Form 037 is no longer in use
As of February 3, 2025, the Spanish government has officially retired Form 037. This change was announced in the Boletín Oficial del Estado (BOE) on January 9, 2025, under Order HAC/1526/2024.
What does this mean for you?
If you're self-employed or a professional in Spain, you'll now need to use Form 036 to register, update, or deregister your details in the Census of Entrepreneurs, Professionals, and Withholders.
Option 1: Request the form online
You can request the modelo 036 Online via the Spanish Tax Agency (Agencia Tributaria).
This method is the quickest and most convenient. You will need a digital certificate, electronic DNI, or be registered in the Cl@ve system. Here’s how you can do it:
- Visit the Tax Agency's website: Navigate to the "Agencia Tributaria - Modelo 36" section.
- Log in securely: Use your digital certificate, electronic DNI, or Cl@ve credentials to access your account.
- Find submitted forms: Look for the "Modelo 036. Consulta de declaraciones presentadas" option to view submitted declarations.
- Select the model and tax year: Choose the Model 036 and the year you wish to download.
- Download the form: Obtain the PDF copy of your submitted form.
💡 Note: Sometimes, instead of the exact form you submitted, the tax agency might provide a "census certificate" ("certificado de situación censal") with your registration info, which is also valid for most official purposes requiring the 036.
Option 2: Request it in person at a Tax Agency office
If you prefer handling the process physically, follow these steps:
-Locate your nearest office: Find the Agencia Tributaria office that corresponds to your registered business address.
- Book an appointment: Schedule an appointment via their website or by phone, as it is required.
- Attend your appointment: Bring your ID and any relevant documents with you.
⏳Note: This option may take longer due to appointment availability and wait times.
Why is bunq asking me for the Modelo 36 form?
Form 036 is your official registration with the Spanish Tax Agency (AEAT). It shows:
Your business is active
You're registered to pay taxes
You've declared your activity and obligations
Without it, we can’t be sure your business is actually registered to operate.
I only have a Modelo 037 at hand, will you accept that as well?
If you registered your business a while ago, you might just have a Modelo 037 at hand. We currently still accept this document for onboarding, so you can send it instead of the Modelo 036 when doing business verification for your Spanish business.
